Orthodontic Co-Management Consultation Service

These Terms & Conditions (“Terms”) govern participation in the Orthodontic Co-Management Consultation Service (“Service”) offered by SmileHQ (“we,” “us,” “our”). By submitting a case for consultation, the referring provider (“you,” “referring provider,” or “practice”) agrees to the following:
Nature of the Service
This Service provides consultation only.
The patient remains at all times the patient of record of the referring provider/home practice.
We do not assume the role of treating provider and do not establish a doctor-patient relationship with the patient.
Scope of Consultation
We review the case materials submitted by the referring provider (e.g., records, imaging, diagnostic data).
We may provide a brief written summary report and/or a scheduled consultation call with the referring provider.
At no time will we communicate directly with the patient. All communications must be conducted through the referring provider.
Responsibilities of Referring Provider
You are solely responsible for:
Obtaining patient consent for co-management consultation.
Submitting accurate and complete records.
Explaining treatment recommendations to the patient.
Executing or delegating all aspects of treatment.
You remain the provider of record and bear full responsibility for the patient’s clinical care and outcomes.
Liability Disclaimer
Our role is limited to providing professional consultation based on the information provided.
We do not guarantee any outcome, and we are not liable for any treatment decisions or procedures performed by the referring provider or their staff.
Responsibility for clinical care, compliance, and follow-up rests exclusively with the referring provider.
Payment Terms
Fees for consultation services will be communicated separately.
Payment must be made in accordance with the agreed terms. Non-payment may result in suspension of services.
Confidentiality and Data Privacy
Patient information is reviewed solely for consultation purposes and handled in compliance with HIPAA and applicable privacy laws.
No patient data will be shared with third parties without written consent.
Termination
Either party may terminate participation in this Service at any time.
Immediate termination may occur if these Terms are breached.
Governing Law
These Terms shall be governed by the laws of Washington, D.C USA.
